This is an action to recover damages for the alleged wrongful arrest and imprisonment of the plaintiff. The complaint alleges the following facts: October 15, 1965, at approximately 4 a. m., the plaintiff was arrested and imprisoned
at a district police station by a police officer of the city of Milwaukee. This was done pursuant to a warrant issued August
6, 1965, for a parking violation alleged to have occurred July 12, 1965. At the time of the arrest, plaintiff informed the
arresting officer he was serving in the United States Marine Corps in Vietnam on July 12, 1965; that he returned to the United
States on August 10, 1965, at which time he was placed in Great Lakes Naval Hospital to recover from wounds received overseas;
also, that the arresting officer, although informed of such facts, made no effort to ascertain the truth thereof and that
plaintiff was imprisoned forcefully and against his will until a friend returned with funds to pay the required amount for
the parking violation citation.
